Welcome to KeywordPic. These Terms of Use govern your use of our website and services. By accessing or using KeywordPic, you agree to be bound by these terms. If you do not agree with any part of these terms, you must not use our services.

2. Definitions

For the purposes of these Terms of Use:

  • "Service" refers to the KeywordPic website and any related services provided by us.

  • "Content" refers to all images, text, metadata, and other materials uploaded or generated through the Service.

3. Registration and Account Security

Users must register with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to suspend or terminate your account if unusual activity is detected.

4. Use of Service

KeywordPic is designed to generate metadata (title, description, and keywords) for photos intended for upload to stock photo platforms. The Service is available only to users aged 18 and older. You agree not to use KeywordPic for any illegal or fraudulent activities, including but not limited to generating metadata for infringing or unlawful content.

5. User-Generated Content

When using KeywordPic, you may upload photos to generate metadata. You retain all rights to the original photos, but you grant KeywordPic a license to use the photos solely for the purpose of generating metadata. We do not store or keep copies of the original photos uploaded by users.

6. Payment Terms

KeywordPic offers paid services in the form of credit purchases. Credits are non-refundable and do not expire. There are no subscription services available.

7. Intellectual Property

All content, software, and other intellectual property on the KeywordPic website are owned by or licensed to KeywordPic. You may not copy, reproduce, modify, distribute, or create derivative works based on our intellectual property without explicit permission.

8. Acceptable Use Policy

You agree to use KeywordPic in compliance with all applicable laws and regulations. You must not:

  • Use the Service to create or distribute content that is illegal, fraudulent, or infringing on the rights of others.
  • Attempt to disrupt or interfere with the Service's operation.
  • Use any automated system, including "bots", to access the Service in a manner that sends more request messages to the servers than a human can reasonably produce in the same period.

9. Termination of Service

We reserve the right to suspend or terminate your access to the Service at our discretion, including but not limited to, for violations of these Terms of Use or for unusual account activity. In such cases, we may provide notice but are not obligated to do so.

10. Limitation of Liability

KeywordPic is provided "as is" without any warranties of any kind, either express or implied. KeywordPic shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service.

11. Indemnification

You agree to indemnify and hold harmless KeywordPic and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of your use of the Service or your violation of these Terms of Use.

12. Governing Law and Dispute Resolution

These Terms of Use are governed by the laws of Poland. Any disputes arising under these terms shall be resolved exclusively in the courts of Poland. By using KeywordPic, you consent to the jurisdiction and venue of these courts.

13. Changes to the Terms of Use

KeywordPic reserves the right to modify these Terms of Use at any time without prior notice. Continued use of the Service after any changes indicates your acceptance of the new terms.

14. Electronic Communications

By using the Service, you agree that all communications with KeywordPic may occur electronically, including through email or notices posted on the website. You agree that these communications satisfy any legal requirements for written communication.
